Can I Modify My Child Support?

Short Answer is, yes, but there are some requirements.

First, the suit to Modify Child Support must be filed in the same court that render the most current order.  Usually that order is the Final Decree of Divorce, an Order in Suit Affecting the Parent-Child Relationship or the most recent Order in Suit to Modify Parent-Child Relationship.  The court that entered this order is deemed to have Continuing Exclusive Jurisdiction under the Texas Family Code in Sections 155.001 (c), 155.002,155.003(a), 156.001, 159.205.

  • The 3 Year Modification Rule

Agreement of the Parties

This is pretty self-explanatory.  In a Texas Child Support Modification Suit, the court will enter an order modifying child support regardless of when it is submitted if the parties agree AND the court believes it is in the best interest of the child.  In practice, if the parties agree to the proposed Child Support Modification Order, the court will almost always approve it.  If some of the changes are a little detailed such as flipping custody, or changing to a 50/50 possession schedule, it helps to have an Experienced Family | Child Support Lawyer that can walk the order through and explain it to the Bryan | College Station, Brazos County Judges.

    3 Year Modification Rule

    In general the court can modify a child support order without the requirement of finding that there was a Material and Substantial Change if at least 3 years have passed since the most active order was rendered and the monthly child support differs by either 20% or $100 from the amount that would be awarded under the current Child Support Guidelines.

        Should I Just Agree to Pay More Child Support to Finish My Divorce?

        Perhaps, but it’s important to really consider the future savings you suspect the agreement will achieve.  If it means the difference of spending $20, 000, $30,000, or more in legal fees combined with the uncertainty of a Judge’s property division decision at trial, then yes it just might be worth it.  However, it’s important to realize that if you agree to a child support obligation that is higher than what you would have been required to pay and your income isn’t anticipated to change, it’s possible that you may not be successful in lowering it later on.

        The Child’s Residence Changed because the Other Parent Moved Now My Travel Costs have Increased?

        What if I Knew my income was going to change before I agreed to the Child Support Order?

        If it can be proven that you knew or should have known based on factual information available to you prior to entering an Agreed Child Support Order, it is possible that you will not be able to modify the child support order if the other parent has retained a knowledge able Brazos County Child Support Lawyer | Family Law Attorney.  Under the Texas Family Code, the parent seeking to modify the child support order based on a Material and Substantial Change must prove that this change in fact occurred after the earlier of (1) the date the most recent order establishing or modifying child support was rendered or (2) the date the parties signed a mediated or collaborative -law agreement on which the order was based. This is illustrated in Texas Family Code Section 156.401(a)(1).  Additionally, many Texas Family Law Courts have held that if it was know that there would possibly be a change in circumstances in one of the party’s lives, it will be presumed that this anticipated change was contemplated and factored into the most recent Child Support Order and as such no material and substantial change will have existed.
